• Warranty Disclaimer

  You acknowledge and agree that you are using the services at your own risk. Really and its representatives, including officers, managers, directors, employees, and agents, explicitly disclaim all warranties, whether express or implied, to the fullest extent allowed by law. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and the absence of latent or other defects, whether or not discoverable. Furthermore, except to the extent required by applicable law, in no event will Really be liable for any loss or damage of any kind incurred as a result of the use of the services or any content posted, transmitted, or otherwise made available via the services, including but not limited to compensatory, consequential, incidental, direct, indirect, special, or punitive damages, regardless of the form of action, whether in contract, tort (including negligence), strict product liability, or otherwise, even if informed of the possibility of such damages.

• Service Provision

  The services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied. Really and its licensors and suppliers (including gift card vendors) do not warrant that the services will be uninterrupted or error-free, nor do they make any warranty as to the results that may be obtained from the use of the services or as to the accuracy, reliability, or content of any information provided through the services.

• Limitation of Liability

  In no event will Really or its affiliates, contractors, employees, agents, or third-party partners or suppliers (including gift card vendors), be liable to you for any special, indirect, incidental, punitive, or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, data or profits, whether or not foreseeable or if Really has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your use of or access to the services or content.

• Program Termination and Changes

  Really reserves the right to terminate any service or reward program without liability, including, but not limited to, any points, prizes, awards, or credits accrued. If external conditions lead to a commercially unreasonable burden to maintain services or value determination, Really is not liable for any alteration, loss, or damage that may result.

• Other Services and Goods

  When you use services, software, or goods provided by third parties through our platform, these may be governed by separate terms between you and the third party. Really is not responsible for the products, services, or information provided by these third parties.

  By using the services, you agree to this limitation of liability and acknowledge that Really does not assume any responsibility for the content, policies, or practices of any third party services, goods, or software.

  You commit to defending, indemnifying, and holding harmless Really, including its directors, managers, officers, agents, contractors, partners, and employees, from all liabilities, claims, demands, losses, damages, costs, and expenses, including reasonable legal fees. These may arise from or relate to: (i) your access and use of the software and services; (ii) breaches of any provisions in these Terms of Use; (iii) your infringement of any third-party rights, including but not limited to intellectual property, privacy, or proprietary rights; (iv) your breach of any laws or regulations; (v) claims alleging that your submissions to the service have caused harm to a third party; (vi) tax implications arising from your utilization of the software; (vii) any content you disseminate through the service; and/or (viii) your negligent or intentional misconduct.

• Changes to Terms

  We may modify these terms at any time. We will notify you of any changes by posting the new terms with a new effective date. Your continued use of Really after any such changes constitutes your acceptance of the new terms.
